Considering the Trump Gold Card?

Before committing $1 million, understand whether you qualify, whether a visa is available, what immigration risks should be addressed, and whether another U.S. immigration strategy may be better for you.

Trump Gold Card Immigration Lawyer

Independent U.S. immigration counsel for investors, entrepreneurs, executives and families considering the $1 million Trump Gold Card.

The Trump Gold Card is a new U.S. immigration program for qualifying foreign nationals who are able to provide a substantial benefit to the United States through a significant financial contribution. The official program currently requires an individual applicant to pay a $15,000 nonrefundable DHS processing fee and, following successful government vetting, make a $1 million contribution to the United States.

A successful applicant may receive lawful permanent resident status through an EB-1 or EB-2 employment-based immigrant classification, subject to eligibility, admissibility and visa availability. Because the program operates within the U.S. immigration system, the financial contribution should not be evaluated in isolation.

For someone considering an irreversible seven-figure contribution, the immigration analysis should come first.

September 11, 2026:

A Major Implementation Update

On September 11, 2026, the Office of Information and Regulatory Affairs concluded review of the Gold Card information collection as “Approved with change.” The updated government record increased estimated annual responses from 1,000 to 1,592, another indication that implementation of the program is moving forward.

This makes it increasingly important for prospective applicants to understand the legal process before submitting an application or committing substantial funds.

How the Trump Gold Card Currently Works

  1. Submit the Gold Card application and pay the $15,000 nonrefundable DHS processing fee.
  2. Complete the immigration petition process and provide supporting documentation requested by USCIS.
  3. Undergo government background and security vetting.
  4. After successful vetting, make the required $1 million individual contribution.
  5. Complete immigrant visa processing and the required interview and documentation.
  6. If approved and otherwise eligible, obtain lawful permanent resident status through the applicable EB-1 or EB-2 classification.

Government requirements and procedures may continue to evolve. Applicants should rely on current official guidance and case-specific legal advice.

Things to Consider when apply for the Trump Gold Card

Here’s what to expect from each step of the EB1A case preparation:

Paying $1 Million Does Not Automatically Guarantee a Green Card

  • The ability to make the contribution is only one part of the analysis. The government states that Gold Card applicants must be eligible for lawful permanent residence, admissible to the United States, and have an immigrant visa available. Prior immigration violations, criminal or security issues, misrepresentation concerns, visa availability and other facts can materially affect a case.

That is why Zhang Law recommends an immigration assessment before a prospective applicant makes the financial commitment.

Trump Gold Card for Spouses and Children

The official program currently allows a spouse and unmarried children under age 21 to be included in the initial application. However, the government currently states that each family member is subject to an additional $15,000 DHS processing fee and an additional $1 million contribution. For a family, the total financial commitment can therefore be substantial and should be evaluated before filing.

Trump Gold Card vs. EB-5

The Trump Gold Card and EB-5 should not be treated as interchangeable products. A Gold Card contribution is a gift to the United States, while EB-5 is an investment-based immigration program with its own capital, job-creation and program requirements. The right strategy depends on the applicant’s objectives, immigration history, family composition, timing, source of funds, risk tolerance and available alternatives.

Could You Qualify Without Paying $1 Million?

For some high-achieving entrepreneurs, executives, researchers, investors and professionals, the Gold Card may not be the only available route to permanent residence. Depending on the facts, an applicant may also wish to evaluate EB-1A extraordinary ability, EB-2 National Interest Waiver, EB-5, L-1/EB-1C multinational executive or manager strategies, or other employment- and family-based options.

Our role is not simply to help a client apply for a Gold Card. It is to identify the strongest U.S. immigration strategy for the client before a major financial decision is made.

U.S. Tax Considerations

The official Gold Card website states that successful permanent residents are subject to U.S. taxation, including on non-U.S. income, as are other U.S. permanent residents. Prospective applicants with significant international assets, businesses or investment income should consider obtaining U.S. tax advice before making a final immigration decision. Zhang Law provides immigration advice and can coordinate with the client’s independent tax professionals; tax advice is outside the scope of immigration representation unless separately provided by qualified tax counsel.

Who Should Consider a Gold Card Strategy Consultation?

A consultation may be appropriate for international investors, founders, business owners, executives, high-net-worth families and other foreign nationals who are financially prepared to make the required contribution but want to understand the immigration consequences and alternatives before proceeding.

Frequently Asked Questions

The official program currently requires a $15,000 nonrefundable DHS processing fee for an individual applicant and, after successful vetting, a $1 million contribution. Other government or visa-related fees may apply.

No. The government states that an applicant must be eligible for lawful permanent residence, admissible to the United States and have a visa available. Approval depends on the applicant’s circumstances and completion of the immigration process.

The official website currently states that processing should take weeks after the application and processing fee are received, assuming requested documents and fees are submitted timely. Zhang Law does not guarantee government processing times.

Yes, qualifying spouses and unmarried children under 21 may be included, but the government currently states that each family member requires an additional processing fee and $1 million contribution.

That depends on your financial goals, immigration history, family structure, timing, risk tolerance and other available immigration classifications. A legal strategy review can compare the alternatives before you commit funds.

Legal representation is not a substitute for the government’s eligibility requirements, but an immigration lawyer can evaluate eligibility, admissibility, visa availability, prior immigration history, family strategy and alternative green card options before a major financial commitment.
